COURT VINDICATES LOCAL DEVELOPER

PARK CITY, UTAH – A Wasatch County Court has dismissed a lawsuit filed by Mayfly Associates, a company owned by Park City Businessmen Rob Karz, Robert Feinberg, and Andy Bernhardt, against local real estate agent George Glauser. The Court has also ordered Mayfly to reimburse Mr. Glauser’s legal fees. The lawsuit arose after Karz, Feinberg and Bernhardt teamed up to buy a Half Million Dollar lot in the Victory Ranch Golf Course community with plans to build an expensive home on the lot that they could sell for a profit. But when the real estate market crashed and it became evident that Mayfly had made a poor investment, Karz, Feinberg and Bernhardt tried to get their money back by filing a lawsuit that accused Mr. Glauser of tricking them to purchase the lot.
After extensive litigation, Fourth District Court Judge Derek Pullan last week entered Summary Judgment in favor of Mr. Glauser and against Mayfly. The dismissal occurred after Mr. Glauser’s attorney, Joe Wrona, argued that Karz and his friends were conjuring up a claim of wrongdoing by George Glauser so they could get out from under their own bad investment. Wrona emphasized that Karz and his friends were claiming the lot was unbuildable when actually they had never even applied for a permit to build on the lot. Judge Pullan focused on that fact and in his ruling stated that Mayfly’s decision to avoid even attempting to obtain a building permit “was not without consequence”.
According to Mr. Wrona, the ruling completely vindicates George Glauser. “George Glauser and Victory Ranch did nothing wrong. Karz and his friends were trying to use litigation to get out of a bad investment they had made, and the Court did the right thing by throwing out the case and awarding Mr. Glauser his attorney fees. It’s a great victory for George Glauser and a healthy dose of karma for Karz and his friends.”
